GENERAL CONDITIONS OF USE
The present general conditions of use (hereafter " CGU ") have for object to define the terms and conditions of use of the site " www.bubble-theater.fr ".
The access and the use of the Site imply the acceptance without reserve of the GCU by the User.
1 - Definitions
For the purposes of the present document:
The term "Site" refers to the website "www.bubble-theater.fr" which is edited by Matthieu Randrianampizafy.
The term "Project" refers to the construction project of the Bubble Theater®.
The term "Content" includes, but is not limited to, the structure of the Site, editorial content, drawings, illustrations, images, photographs, graphic charts, trademarks, logos, acronyms, corporate names, audiovisual works, multimedia works, visual content, audio and sound content, and any other content present on the Site.
The term "Elements" refers to the various functionalities and information elements offered on the Site.
The term "User" refers to any natural person of legal age who is browsing the Site for strictly personal and non-commercial purposes, without any direct or indirect profit-making purpose.
2 - Purpose of the Site
The Site is a portal allowing the User to :
- Discover the concept of the Project, its eco-responsible vision, its business prospects and its partners.
- Follow the news of the Project.
-Discover the investment opportunities related to the Project.
This list is not exhaustive and can be modified at any time by Matthieu Randrianampizafy without his responsibility being engaged for this reason.
3 - Access to the Site
The Site is accessible from the Internet at the following address: www.bubble-theater.fr
4 - License to use the Site
Matthieu Randrianampizafy grants the User a personal right to use the Site, the Content and its Elements in a non-exclusive, revocable, non-transferable and free manner. This license is granted to the User solely for his/her personal needs, and it is expressly forbidden to exploit commercially or for profit all or part of the Content and/or the Elements.
By accepting these conditions, the User acknowledges that he/she acquires no other rights to the Site, the Content and/or the Elements other than those granted herein.
5 - Obligations of the User
By using the Site, the User must respect the national and international regulations in force. The User also agrees to :

- not to reproduce, even partially, the Site or its Content, in any form and by any means whatsoever
- not to access or use the software components of the Site
- not to use software or processes that may copy the Content or disrupt the proper functioning of the Site
- not to modify, translate, compile, decompile, assemble, or disassemble all or any part of the Site, the Elements or the Content
- export or merge the Site with other computer programs
- inform Matthieu Randrianampizafy in case of hacking or illicit or non-contractual use of the Site or its Content
- not to manipulate the Site or introduce viruses or malicious code that could disrupt the proper functioning of the Site or the Elements accessible via the Site
- not to interfere with the proper functioning of the Site in any way whatsoever

The User is solely responsible for the use of the Site and acknowledges that neither Matthieu Randrianampizafy nor the members of his distribution network may be held responsible for direct or indirect damages resulting from access to or use of the Site or its Elements, in particular in the event of interruption, suspension or modification of the Site or of one of its Elements.
6 - Availability of the Site
The Site is generally accessible at all times, except in cases of force majeure or unforeseen events beyond the control of Matthieu Randrianampizafy, as well as for possible breakdowns or maintenance operations necessary to ensure the proper functioning of the Site.
7 -Responsibility - Guarantee

The use of the Site is at the User's own risk. He must take the necessary measures to protect his own data and software stored on his equipment against any attack.
Matthieu Randrianampizafy will not be held responsible in the following cases:
- if the User does not respect the general conditions of use;
- if the Site malfunctions due to a cause attributable to the User, a third party or a malicious act, software, smartphone/tablet, interface or any other product or supply of the User;
- in case of malfunction or failure of the User's computer or communication network, whatever the cause.
Matthieu Randrianampizafy does not guarantee that the Site is free of errors or anomalies, nor that it cannot be attacked by viruses or suffer malfunctions, interruptions, breakdowns or losses of data or information.
8 - Personal data
The use of the Site may require the collection of personal data allowing direct or indirect identification of the User.

9 - Intellectual and Industrial Property
The Site and all its contents are protected by intellectual and/or industrial property laws.
The photographs, texts, slogans, drawings, images, animated sequences, whether they are sound or not, as well as all the works integrated on the Site belong to Matthieu Randrianampizafy or to third parties having authorized Matthieu Randrianampizafy to use them or having yielded their rights to Matthieu Randrianampizafy.
The names BUBBLE THEATER and the associated products and services, the slogans and logos which accompany this mark are, unless otherwise indicated, registered trademarks of Matthieu Randrianampizafy.
It is allowed to reproduce the Contents on a paper or data-processing support, provided that this reproduction is strictly reserved for a personal use and excludes any use with advertising, commercial or information purposes, in accordance with the provisions of article L122-5 of the Code of the Intellectual property.
Apart from this provision, any reproduction, imitation, use or affixing, by any means whatsoever and on any medium whatsoever, of all or part of the Content without the prior authorization of Matthieu Randrianampizafy or the holders of the corresponding rights constitutes an infringement of copyright, punishable by a maximum penalty of four years' imprisonment and a fine of 400,000 €.
10 - Applicable law
The Site and the terms and conditions of use are governed by French law, except in the case of mandatory rules in the user's country of residence.
In the event of a dispute over the interpretation and/or execution of the terms and conditions, the parties must first try to find an amicable solution.
If no amicable solution is found, the dispute will be submitted to the courts of Paris, whose exclusive jurisdiction is attributed to the parties, regardless of the number of defendants or claims for compensation from third parties.
11 - Updating of the TOS
Matthieu Randrianampizafy reserves the right to modify and update the General Terms of Use (GTU) without prior notice, at any time and without informing users in advance.
If changes or updates are made, they will be effective upon their publication on the Site and the User will be required to review the current GTU at each connection to the Site.
12 - Miscellaneous provisions
12.1 - Non-waiver
The fact that a party does not invoke a clause of the present GTU cannot be interpreted as a temporary or definitive renunciation of the benefit of the said provision which will remain in force.
12.2 - Nullity of a clause
In the event that one or more stipulations of these GCU are declared invalid, void or unwritten due to a change in the regulations in force or following a final decision of a competent court, the other stipulations will remain in force and will be fully applied. The parties agree to establish a new valid replacement provision of equivalent scope to the original provision.
12.3 - Force majeure
In addition to the cases usually retained by the jurisprudence of the French courts, bad weather, governmental and legal restrictions and modifications, computer breakdowns and telecommunication interruptions, failure of servers as well as any other case beyond the control of Matthieu Randrianampizafy are expressly considered as cases of force majeure.
